EXTREME PITA PANASONIC PLASMA TV CONTEST



OFFICIAL CONTEST RULES & REGULATIONS

 

This Contest is sponsored by The Extreme Pita National Marketing Fund Canada Inc. cob as Extreme Pita® (the “Sponsor”).

 

No purchase or payment of any kind is necessary to enter or win this contest.  This contest is open to legal residents of Canada (excluding residents of the Northwest, Yukon Nunavut territories and the province of PEI), who have reached the age of majority in the jurisdiction in which he or she resides at the time of entry.  Void where prohibited by law.

 

 

HOW TO PARTICIPATE

 

1.   The Contest starts on November 1, 2008 and ends on December 24, 2008, and all entries must be postmarked or received on or before January 9, 2009, at 11:59 pm Eastern Time (the "Contest Closing Date").  There are two (2) ways to enter this contest: 
  1. Approximately 12,000 Entry Forms will be available at participating Extreme Pita® locations throughout Canada (excluding the Northwest, Yukon and Nunavut territories and the province of PEI) while supplies last. Complete the Entry Form with your full name, complete mailing address (including postal code), daytime telephone number (including area code), age, email address (if applicable) and a copy of a catering receipt from Extreme Pita® of $75 or more before taxes between the dates of November 1, 2008 and December 24, 2008 mailing it to: Extreme Pita Plasma TV Contest, Unit 14 – 5250 Satellite Drive, Mississauga, Ontario L4W 5G5.  An Entry Form will be provided to Extreme Pita® customers with each catering order of $75 or more (exclusive of any applicable taxes).  All entries must be postmarked on or before January 9, 2009.
  1. Email us a copy of a catering receipt from Extreme Pita® of $75 or more (exclusive of any applicable taxes) between the dates of November 1, 2008 and December 24, 2008 providing your full name, complete mailing address (including postal code), daytime telephone number (including area code) and age to plasmatv@extremepita.com.  All entries must be received by us on or before 11:59 pm Eastern Time on January 9, 2009.

Email entries generated by script, macro, robotic, programmed, or any other automated means are prohibited and will be disqualified.

3.   PRIZE DESCRIPTIONS

 

Grand Prize: There are two (2) Grand Prizes available to be won, each consisting of a Panasonic 42” Plasma HDTV, model # TH42PX80. The approximate retail value of each Grand Prize is $1,200 CDN.  Any additional options or accessories are at the sole expense of the winner. Prizes must be accepted as awarded without substitution and are not transferable, not for resale and have no cash surrender value. The Sponsor reserves the right, at its sole and absolute discretion, to substitute any prize awarded with a prize of equivalent or greater value for any reason. The Sponsor makes no express or implied warranties of any kind with respect to the safety, appearance or performance of the prize.  Prizes may not be exactly as shown.

 

DRAWS: Random draws will be held on January 30, 2009 starting at 10:00 AM (ET) at the offices of Brand Culture 5250 Satellite Drive, Mississauga, Ontario, drawing two (2) names for the Grand Prize from all eligible entries received on or before the Contest Closing Date.  Odds of being selected depend on the total number of eligible entries received on or before the Contest Closing Date. Selected entrants will be contacted by mail or telephone within seven (7) days of the draw date. If a selected entrant cannot be contacted by mail or telephone within seven (7) days of the draw date, his/her entry will be disqualified and another entrant will be randomly selected until such time as contact is made by mail or telephone with all two (2) selected entrants. Failure to comply with any of the contest rules herein, will result in the disqualification of the potential winner. In this event, a new random draw from the valid entries received will be performed to award the prize and the potential winner must be able to be reached by phone or by mail within three (3) days of the new draw, failing which another draw will be held within a subsequent equal timeframe up until such a time as an official winner is declared. Notwithstanding the foregoing, all winners must be declared on or before February 27, 2009, otherwise the prizes will be void. If, as a result of an error relating to the entry process, drawing or any other aspect of the Contest, there are more potential winners of prizes than contemplated in these rules, the Sponsor, at its discretion, may conduct a random draw amongst all eligible prize claimants after the Contest Closing Date to award the prize(s) set out in these rules or may terminate or amend the Contest in whole or in part without notification to contest participants.

     
4.   ELIGIBILITY: Unless otherwise indicated, to enter and be eligible to win, a person must be a resident of Canada (excluding residents of the Northwest, Yukon and Nunavut territories and the province of PEI), who has reached the age of majority in the jurisdiction in which he or she resides at the time of entry and who is not an employee of the Sponsor,  its affiliated companies or agents, franchisees, or advertising or promotional agencies, the judging panel or a member of any such employee’s immediate family (regardless of where he or she lives) or persons with whom they are domiciled (whether related to the employee or not). In these Official Rules, “immediate family” means mother, father, brothers, sisters, sons, daughters, spouse, or household.  The Contest is also void in any jurisdiction where prohibited by law; subject to all federal, provincial, and local laws, rules, and regulations.
     
5.   NO PURCHASE IS NECESSARY.  You may also participate without purchase by mailing your request to be entered to the following address: Extreme Pita Plasma TV Contest, Unit 14 – 5250 Satellite Drive, Mississauga, Ontario L4W 5G5 along with a 30 word description of how you enjoy Extreme Pita® catering services, your full name, complete mailing address (including postal code), daytime telephone number (including area code), age and e-mail address (if applicable).  Limit one mail-in request per postage stamped envelope, to a maximum of one entry per household.  Mail requests must be postmarked on or before January 9, 2009.
     
6.   GENERAL: By entering the Contest, entrants agree to abide by the Official Rules and the decisions of the Sponsor and the judging panel with respect to all aspects of the Contest, which are final, binding and conclusive on all matters relative to this Contest.  The Official Rules will be posted on the Website throughout the Contest period.  The Sponsor reserves the right at its sole discretion to disqualify from this Contest or any other promotion conducted now or in the future by the Sponsor or any of its affiliates, any individual found to be tampering with the entry process or the operation of the Contest; or to be acting in any manner deemed by the Sponsor to be in violation of the Official Rules; or to be acting in any manner deemed by the Sponsor to be unsportsmanlike or disruptive, or with intent to annoy, abuse, threaten or harass any other person.
     
7.   Before being declared a winner, each selected entrant must first correctly answer without assistance of any kind, whether mechanical or otherwise, a mathematical skill-testing question posed by mail or telephone within three (3) days of being notified. The selected entrants will be required to sign a Declaration and Release Form confirming compliance with the official rules, acceptance of the prize as awarded, without substitution, consent to the disclosure of certain information to the public and releasing the Sponsor, its affiliated and related companies, franchisees, advertising and promotional agencies, the judging panel and their respective shareholders, directors, officers, employees, agents, representatives, successors and assigns from any liability in connection with the prize or this Contest. The Declaration and Release Form must be returned within the time period specified on the document or the prize may be forfeited. Grand Prizes will be delivered to the confirmed winners by the Sponsor within thirty (30) days of receiving the completed Declaration and Release Form.
     
8.   By entering, subject to the Sponsor’s privacy policy described directly below, each winner consents to the use of his/her name, address (city and province), photograph and/or any part of the video or video clips without further remuneration, in connection with any publicity carried out by or on behalf of the Sponsor with respect to this Contest.  Except where prohibited by law, the winner grants to the Sponsor the right to print, publish, broadcast and use worldwide in any media now known or hereinafter known (including without limitation use online at the Website) the winner’s name, address, voice, statement, picture or other likeness and the video submitted, without additional compensation, for any public relations, advertising or promotional purposes, as may be determined by the Sponsor.  The Sponsor respects your right to privacy. Personal information collected from entrants will only be used by the Sponsor to administer the Contest and if consent is given at the time of entry to provide the entrants with information regarding upcoming promotions and or events from The Extreme Pita® by email. By entering the Contest, entrants consent to the manner of collection, use and disclosure of personal information as set out in The Extreme Pita® Privacy Policy, which is available at www.extremepita.com.
     
9   The Sponsor will not be responsible for late, lost, illegible, incomplete, falsified or destroyed entries and all such entries are void.  The Sponsor does not assume any responsibility for incorrect or inaccurate capture of entry information, technical malfunctions, human or technical error, printing errors, lost, delayed or garbled data or transmissions, omission, interruption, deletion, defect or failures of any telephone or computer lines or networks, computer equipment, software or any combination thereof.  Entry materials/data that have been tampered with or altered are void. In the event it is determined that an entrant has entered an entry form in a fashion not sanctioned by these rules and/or has submitted more than the number of entries permitted by these contest rules, the entrant will be disqualified and all of the entries submitted by the entrant will be disqualified.  The Sponsor assumes no responsibility or liability for (a) any incorrect or inaccurate entry information, or for any faulty or failed electronic data transmissions; (b) any unauthorized access to, or theft, destruction or alteration of entries at any point in the operation of this Contest; (c) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers utilized in any aspect of the operation of the Contest; (d) inaccessibility or unavailability of the Internet or any combination thereof; (e) any injury or damage to any person's computer which may be related to or resulting from any attempt to participate in the Contest or access or download of any materials or other information in connection with the Contest.
     
10.   The Sponsor reserves the right to cancel, terminate, modify, or suspend in whole or in part the Contest without prior notice and without liability. Without limiting the foregoing, if, for any reason, the Contest is not capable of running as originally planned, such as tampering or infection by computer virus, the Sponsor reserves the right, to cancel the online portion of the Contest and conduct the draws from all previously received eligible online entries and all ballot entries received by the Contest Closing Date. The Sponsor shall not be held responsible for any problems, errors or negligence that may arise or occur in connection with the Contest including but not limited to, any damage to an entrant’s computer equipment, system, software or any combination thereof, as a result of the entrant’s participation in this Contest.  The Sponsor reserves the right to correct clerical or typographical errors in any promotional materials relative to the Contest.
     
11.   All entries become the permanent property of the Sponsor and none will be returned. No correspondence will be entered into except with the selected entrants. This Contest is void where prohibited by law and is subject to all applicable federal, provincial and municipal laws and regulations.  Any dispute arising hereunder shall be adjudicated in the applicable court in Toronto, Ontario. 
     
12.   In the event of a dispute regarding the identity of the party submitting an email entry, the entry will be deemed to have been submitted by the holder of the email account.
     
13.   Residents of Quebec: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcohols, des courses et des jeux (the “Régie) for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
